Guarantee Terms and Conditions

Effective Date: 02Nov2025

This Guarantee Terms and Conditions document (Terms) explains the measurable results guarantee offered by Athletic High Performance (AHP). By enrolling in an AHP program you accept these Terms. These Terms work alongside AHP’s general enrollment agreement, payment terms, and privacy policy.

Definitions

  • Program Block means a single predefined training cycle delivered by AHP, typically 4–12 weeks as described in program materials.
  • Participant means the enrolled athlete named on the enrollment record.
  • Coach means the AHP coach assigned to the Participant for the Program Block.
  • Guarantee means the corrective extension offered by AHP under these Terms when eligibility and outcomes criteria are met.
  • Corrective Extension means an additional 4-week training block provided at no additional tuition cost to address measurable underperformance.

  

Miscellaneous Terms

  • Modification AHP may update these Terms periodically. The version in effect on the Program Block start date governs that Block.
  • Assignment AHP may assign its rights and obligations under these Terms to an affiliated entity.
  • Governing Law These Terms are governed by the laws of the State of Texas without regard to conflict of law principles. Venue for disputes shall be the county of Montgomery, Texas except where otherwise required by law.

Guarantee Summary

AHP guarantees a corrective extension for Participants who meet the eligibility requirements below and do not demonstrate measurable improvement in agreed performance metrics by the end of the Program Block. The Guarantee provides one corrective extension only and is limited to the terms described in this document.

Eligibility Requirements

To be eligible for the Guarantee the Participant must satisfy all of the following during the Program Block:

Attendance

  • Attend at least 80% of scheduled coached sessions within the Program Block. Attendance is calculated as attended coached sessions divided by scheduled coached sessions for that block.
  • Missed sessions may be covered by allowed makeups up to the limit defined in AHP’s Makeup Policy.

Testing Compliance

  • Complete AHP baseline testing at Program start and final testing at Program end according to AHP Test Protocol. Tests must be performed during scheduled retest windows. Missing the final test voids Guarantee eligibility.

Homework and Habit Work

  • Complete assigned habit work and home practice as documented in the habit tracker and verified by the Coach. Habit work includes but is not limited to prescribed mobility, sleep, nutrition, and prescribed at-home drills.

Coach Progression Compliance

  • Follow the Coach’s prescribed progressions and retest schedule. Repeated nonadherence to coach instructions documented by the Coach will void eligibility.

No Unreported Medical Exclusion

  • Disclose medical conditions, recent surgeries, or clinician restrictions before Program start. New or undisclosed medical issues that substantially limit participation may affect eligibility; see Injuries section.

Timely Communication

  • Report absences, injuries, or medical issues to Coach or Ops within 48 hours of occurrence and follow required intake or clinician processes where applicable.

Measurable Improvement Definition

  • Primary Metrics are the performance measures agreed at enrollment and recorded in the baseline dossier (examples: Fly‑10 velocity, 0–30m time, CMJ, positional pop time).
  • Measurable Improvement means the Participant achieves a pre‑specified improvement threshold for the primary metric(s) defined in the participant’s dossier or program page. Typical program thresholds are expressed as percentage improvements or absolute time/score reductions detailed in the program materials. exact thresholds are published in the program dossier available to Participants.

Examples of Qualifying and Nonqualifying Scenarios

  • Qualifying Example 1: Participant attends 29 of 36 scheduled sessions (81%), completes habit tracker with coach verification, completes final testing, and shows improvement below the program threshold → Eligible for corrective extension.
  • Nonqualifying Example 1: Participant misses 12 of 36 scheduled sessions, does not complete the final test, and demonstrates inconsistent adherence → Not eligible.
  • Injury Example: Participant sustains a documented injury mid‑block, completes RTP intake, receives clinician clearance, resumes training, completes final retest within allowed retest window → Eligibility reviewed and commonly preserved with clinician documentation.

Corrective Extension Process

Flagging

  • Coach identifie underperformance during Weeks 9–11 and documents attendance, habit compliance, and test deltas.

Review

  • Operations reviews Coach documentation, test results, and Participant adherence to eligibility requirements.

Approval

  • If eligibility is confirmed, AHP authorizes a one-time Corrective Extension of 4–weeks tailored to the Participant’s needs. Exact extension length and scope are determined by the Coach and Operations.

Scheduling

  • Ops schedules the extension within 60 days of final test review, subject to cohort capacity and       Participant availability.

Retest and Final Report

  • Participant completes extension and retesting. Coach delivers a final report comparing baseline, Program end, and post-extension metrics.

Escalation

  • If post-extension metrics still fail to meet thresholds, Participant or Parent may escalate to the       Guarantees Team for a formal case review and written determination.

Limitations and Exclusions

  • The Guarantee is limited to one corrective extension per Participant per Program Block.
  • Guarantee does not refund tuition, cover travel costs, or compensate for indirect costs such as missed games or lost opportunities.
  • Guarantee does not apply when nonadherence to Coach instructions, false or withheld medical information, or documented poor faith participation is the primary cause of nonimprovement.
  • Guarantee does not apply to outcomes outside AHP’s control including but not limited to catastrophic injury, major illness, or circumstances beyond AHP’s control such as natural disasters or public health orders that prevent delivery of services.

Makeup Policy Interaction

Allowed makeups are described in AHP’s Makeup Policy. Eligible makeups (up to allowed limit) count toward attendance for Guarantee calculation if they are scheduled and attended within the defined makeup window. Excess missed sessions beyond makeups may void Guarantee eligibility unless appeal is approved for extenuating circumstances.

   

Injury and Clinician Exceptions

Verified injuries documented through AHP’s clinician intake process may create a protected buffer for missed sessions. To preserve Guarantee eligibility when injured, the Participant must: notify Coach immediately, complete the RTP intake, follow clinician guidance, and complete final retesting within the clinician‑defined retest window. AHP retains sole discretion to require clinician clearance documentation.

Appeals and Dispute Resolution

  • To file an appeal of a Guarantee decision, submit a Guarantee Appeal Form at guarantees@athletichealthandperformance.com with supporting documentation, including attendance logs, habit tracker records, test data, and clinician notes if applicable. Appeals must be submitted within 30 days of the final report issuance.
  • AHP will acknowledge appeals within 3 business days and issue a written determination within 14 business days of receipt of complete materials.
  • If the Participant disagrees with the determination, Parties will first attempt informal resolution. If unresolved, Parties agree to mediation before any other formal dispute mechanism, except where law requires otherwise.

Data, Testing, and Consent

All testing data used for Guarantee decisions are collected under AHP’s Test Protocol and stored according to our privacy policy. Participant and Parent consent for testing and data use is required at enrollment. AHP will provide raw test files and dossiers upon request to support appeals.

  

Acceptance

By enrolling in an AHP Program Block the Participant and Parent/Guardian acknowledge they have read, understood, and agree to these Guarantee Terms and Conditions.
